Terms of service
These terms are between Trev The Dev (Pty) Ltd, trading as TTD Consulting ("TTD", "we"), and the company that opens an EngageDesk account ("you"). The person who accepts them for you confirms they may bind your company.
1. EngageDesk
- EngageDesk is a CRM for Microsoft partners, provided online as a subscription. We run it, keep it secure and improve it.
- What each plan includes is shown under Settings → Plan and billing. We may add to EngageDesk; we won't take away something your plan includes during a period you've paid for.
2. The free trial
- A new company gets one 30-day trial. Nothing is charged, and nothing renews into a payment by itself.
- When the trial ends without a plan, the account becomes read-only for 30 days: you can read, export and erase people, but not change anything. After that it's suspended; your data is kept until you or we close the account.
3. Plans and payment
- Plans are priced per person who can sign in, per month, in South African rand, excluding VAT. VAT is added where it applies.
- Paid by card through Paystack, you pay monthly in advance, and each payment is listed under Settings → Plan and billing; we send a tax invoice on request. Bought through the Microsoft commercial marketplace, Microsoft bills you on its terms, and its prices and invoices apply.
- If a payment fails, everything keeps working for 7 days. If it stays unpaid, the account becomes read-only as in section 2.
- We give at least 30 days' notice of a price change, and it applies from your next period.
4. Cancelling
- The owner can cancel any time under Settings → Plan and billing. It takes effect at the end of the period you've paid for, with no refund for the rest of that period.
- After it ends, the account is read-only for 30 days so you can export everything; then the account and all its data are deleted. Backups keep a copy for up to 30 more days, then it's gone.
- The owner can also close the account at once and delete everything, under Settings → Data and privacy.
5. Your data
- What you put into EngageDesk is yours. We process it only to provide EngageDesk to you, as set out in the POPIA operator agreement, which forms part of these terms.
- You're responsible for having a lawful basis for the personal information you keep, and for what your people do in your account.
- We can't see inside your account. If you'd like our help inside it, your owner lets TTD support in for a few days; it ends by itself.
6. The AI features
- EngageDesk's AI drafts, suggests and summarises. It can be wrong: check what it drafts before you rely on it or send it.
- You choose how much each AI feature does by itself (Settings → AI). Each plan includes an AI allowance a month; past it, EngageDesk gives its quick answers that don't use AI until the next month.
7. Fair use
Don't use EngageDesk to break the law, send spam, store anything you have no right to keep, or try to reach another company's data or disrupt the service. We may suspend an account that does, and will tell its owner why.
8. Availability and support
- We aim for EngageDesk to be available 99.5% of each month, not counting planned maintenance, which we announce at least two days ahead where we can. This is a target, not a guarantee, and no service credits apply.
- TTD provides support by email at info@ttdconsulting.net, on South African business days from 08:00 to 17:00, usually answering within one business day.
9. Liability
To the extent the law allows, we aren't liable for indirect or consequential loss, or for lost profits or data you could have exported, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act, 2008, where it applies.
10. Changes and law
- We may change these terms. A change that affects you is shown to your owner, who accepts it at their next sign-in; if you don't accept, you can cancel.
- These terms are governed by the law of South Africa, and its courts have jurisdiction.
